Our fees for our services and disbursements as lawyers are in principle governed by the tariff of the
Bar
Association of the Canton of Valais as well as the canons of professional ethics of the Swiss and Valais Bar
Associations. Any increases and reductions in the basic rates are governed by the fee schedule regulation.
Any disbursements and expenses incurred are to be additionally reimbursed.
As a rule, fee advances are required. The advance must be reasonable. If the advance is not paid, the lawyer
may cease to act for the client – provided this is not done at an inopportune time.
In the case of court work, the fee (incl. disbursements and expenses) is in principle determined by the court
tariff. If the fee according to the court tariff does not represent reasonable payment, the remainder shall be
additionally charged to the client. Costs and damages awarded to the opposing party or to the treasury shall
be charged to the client's fee account.
In addition, in accordance with professional standards and the canons of professional ethics, the following
is to be observed:
– The fee must be reasonable. Reasonableness is assessed according to the specific circumstances,
the difficulty and importance of the matter, the interests of the client, the lawyer's own professional
experience, the prevailing practice and the outcome of the proceedings.
– It is permissible to agree all-inclusive fees, but these must correspond to the expected performance
of the lawyer. Prior to ending litigation, it is not permissible to make an agreement regarding receipt of a
portion of the recovery to replace the fee (pactum de quota litis), nor is it permissible to waive the fee,
in the event of an unfavourable outcome of the proceedings.
– It is permissible to agree a success premium, which shall be due in addition to the fee (pactum de palmario).
The fee shall be determined in accordance with the notarial tariff for services as a notary. The notarial tariff
is a state tariff and the notary is prohibited, under threat of punishment, from deviating from the tariff.
